4. Disclaimer of Warranty

The Service is provided on an "as is" and "as available" basis. KidBit.App makes no warranties, expressed or implied, regarding the reliability, availability, accuracy, completeness, fitness for a particular purpose, or non-infringement of the Service. You use the Service at your own risk.

5. Limitation of Liability

In no event shall KidBit.App be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use or inability to use the Service, including but not limited to loss of data, loss of profits, or business interruption. KidBit.App's total liability under this Agreement, whether in contract, tort, or otherwise, shall not exceed the amount paid by you, if any, for accessing the Service.

6. Indemnification

You agree to indemnify, defend, and hold harmless KidBit.App and its affiliates, officers, directors, employees, and agents from any and all claims, liabilities, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or in connection with your use of the Service or violation of this Agreement.

7. Modifications to the Service

KidBit.App reserves the right to modify, suspend, or discontinue the Service or any part thereof, with or without notice. KidBit.App shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia. Any legal action or proceeding arising out of or relating to this Agreement shall be exclusively brought in the courts located in the Commonwealth of Virginia, and you consent to the jurisdiction of such courts.
